UN confirms: No transfer of jurisdiction to EU

This pretty much guarantees Kosovo Province will remain a glorified colony indefinitely. I doubt those states that recognized Pristina's unilateral declaration of complete and utter dependence on the West will withdraw such recognition, but it places further egg on the faces of those who thought they could just run ramrod over international law. Now maybe the UN could actually grow a pair and implement a policy of delegitimizing the EU's colonial mission.

wow!!! US and EU plans went the way of the dodo. no matter what, albans remain citizens of Serbia. im assuming they US will start making an exit strategy now.

This is great news. But what really surprised me is the very low number of Albanian comments on this article and their quiet and almost humble responses. So I guess it must be a pretty severe blow to them and they are trying hard to get their act together (I am sure they will be back). Unknown Comic, there is no delay. Gjipela, this is democracy and international law. Smile, it is up to Mr. Ban Kim Moon and the UNSC (and you know how has the upper hand there). The EU has been put into its place again and this public humiliation was what the doctor ordered for some of its arrogant unelected technocrats. At least it has been proven that Serbia's claims on this matter were not some kind of imagination blah blah. There is still a long way to go, but every small battle won counts as well.

keep that in mind. ban wants to, but it makes no difference, its up to unsc, and they said it loud and clear. and ban does not dare to so shamelessly destroy the organization he works for. persistent indeed. the eu is a festering boil on the face of mankind :)

Yesterday I was up the walls because my home land approved this illegal UDI eventhough no longer than a week ago our Govnt speach was completely different as to how to address this problematic case. God knows what happened in between, maybe an arm twisting by the Germans who want to crack our famous bank secret protection...
Today am glad that finally UN woke up and reminded everyone that the rule of law can't simply be forgotten!

It seems that law will prevail after all and what is most important is that resolution 1244 is very alive and in force. Another important fact is that UN still has say on the matter and some authority that guarantees the sovereignty of its member states. It would be wise to leave the things as they are and stop insisting on further breaching of the law since it may become very dangerous for the entire world. The UN and EU are deeply divided on Kosovo issue and the more EU takes illegal steps the more chances to create even bigger mess.

Any way, the UDI came to early and in wrong moment. It acctually never supposed to take place. It is not that simple to grab and steal someone elses' land, that is called robbery in civilized world. The EU encouraged this illegal act and thus will suffer the loss of its credibility. I hope Albanians will realise now that they are in even worse position now than they were 2 weeks ago. It is time to come back to negotiating table and accept Serbia’s generous offer, otherwise Albanians risk to lose everything.

Wonder what happens next?

I guess, most of the readers misunderstand the future role of EULEX in Kosova! It is not going to replace UNMIK in order to exercise the authority that UNMIK had during these years. The EULEX Mission's task in Kosova is to assist and advise the institutions of the newborn state. There is a significant difference between them, isn't it?

It is about time that Mr Ban Ki Moon layed down the law to the illegal EULEX group. He as the UN Secretary General must maintain and protect the jurisdictional rights of Serbia according to UN resolution 1244.

The EU has been sloppy - international law does mean something. It has been clear to anyone who reads the law that this has not been thought through properly.

I would go further to say that the whole of the politics surrounding this has been incredibly sloppy. Kosovo is going to remain in a legal mess that will probably never be resolved. Democratic Serbia has been put into a corner quite unnecessarily.

Milosevic was bad news, but he went some time ago - kicked out by the Serbs and sent to the Hague by the Serbs. The US thinking has not moved on but the EU should have been able to negotiate something better than this divisive independence declaration.

1244 quite clearly speaks of autonomy - so the international community have been willfully incompetent in going against that. They have made themselves liars by signing falsely at the end of the conflict - if they were always intending that independence takes place that actually makes the NATO intervention illegal under international law - criminally illegal.

The really sad thing is that the move towards EU membership could have been the basis for lots of agreements from both sides.

Instead the international community have rewarded the nationalistic ambitions of the Albanians in Kosovo. The Albanians were probably much more the cause of the trouble than the Serbs; their ethnic cleansing of Serbs and single minded mono-ethnic ambition has been the most continuously present feature of the troubles in the region for decades.

The politicians and diplomats from the EU could have done better. The worst are those who held their hands up saying 'this is not a good solution but there was no other choice'. That was rubbish and they were just lazy. If they haven't got the imagination or the energy, those politicians are the ones we do not need.

Looks like international law is catching up with the EU. I would like to see justification for their mission now as an international presence already exists. No invitation by the secretary general either.

This really cannot go much further without going back to the negotiating table and the US having realistic attitude.

No new recognitions today and there is only a handful extra expected.

I was wondering; What about democracy in international system. Ban Kim Moon is looking like a dictator amid european institutions and United Nations Security Council members.
Of course I understand that the fucktion of institutions and international bodies is based in bureaucracy but the "Pending" issue is being abused in a large extend regarding kosovo issue.

it´s simply not up to him to make decisions.

that´s certainly something that won´t be appreciated by the serbian citizens of albanian ethnicity, but, it will give them a little hint of what is really binding law
(and of course on which territory they live).

let´s just see what future brings, I mean the usual clueless comments of some albanian kids in regard to their "independence" taken aside.

And they seem to be right about that (according to the UN).

Which means that everything will stay as it was. This is a big step forward for Serbia, Russia and the many countries that were against this illegal act of a few runaway countries.

OK, things are finally clear and resolved. Not it is time for REAL negotiations and compromises (not false promises and the lack of doing something).

That may take a while. I wonder if the Kosovo Albanians can deal with this blow and if they can show patience or if they will flip and try to take Kosovo by force now, fighting the NATO masters. This is going to be a very interestig new phase.

"As for Joachim Ruecker, UNMIK's chief in Kosovo, he has been told to continue with his job and do everything to ensure stability in the province, according to Ban's spokesman."

That is right. Keep your mouth shut unless ask to speak, keep a low profile and do what you are paid (by the UN) to do.

"He also confirmed that no new UN SC session on Kosovo has been scheduled."

So nothing will change. I think the ball is now in the corner of the US and its lackies who support the NATO/KLA colony. Russia's upper hand has grown a lot today.

"Russia will preside over the Council in March, and it will put together the agenda, it has been confirmed. Whether and in what format the Kosovo crisis will be discussed, is up to Moscow."

Who cares about the letter. What is important is that things are 100% clear (unless there is something wrong with you), that the EU has been put in its place and that there is a chance again to come up with a real lasting solution that will be good for all (especially the people directly involved).

"But the BBC quotes its sources on the East River who said the EU is "persistently asking the secretary-general to personally approve UNMIK's replacement with EULEX"."

Oh my God, the EU is very very desperate. I expect the UN not to give in no matter how much pressure from certain EU countries. I think it is time to open a bottle of wine and toast on an important victory. Cheers.

The Albanians were probably much more the cause of the trouble than the Serbs; their ethnic cleansing of Serbs and single minded mono-ethnic ambition has been the most continuously present feature of the troubles in the region for decades.

The politicians and diplomats from the EU could have done better. The worst are those who held their hands up saying 'this is not a good solution but there was no other choice'. That was rubbish and they were just lazy. If they haven't got the imagination or the energy, those politicians are the ones we do not need.

It is about time that Mr Ban Ki Moon layed down the law to the illegal EULEX group. He as the UN Secretary General must maintain and protect the jurisdictional rights of Serbia according to UN resolution 1244.

It seems that law will prevail after all and what is most important is that resolution 1244 is very alive and in force. Another important fact is that UN still has say on the matter and some authority that guarantees the sovereignty of its member states. It would be wise to leave the things as they are and stop insisting on further breaching of the law since it may become very dangerous for the entire world. The UN and EU are deeply divided on Kosovo issue and the more EU takes illegal steps the more chances to create even bigger mess.

Any way, the UDI came to early and in wrong moment. It acctually never supposed to take place. It is not that simple to grab and steal someone elses' land, that is called robbery in civilized world. The EU encouraged this illegal act and thus will suffer the loss of its credibility. I hope Albanians will realise now that they are in even worse position now than they were 2 weeks ago. It is time to come back to negotiating table and accept Serbia’s generous offer, otherwise Albanians risk to lose everything.

Yesterday I was up the walls because my home land approved this illegal UDI eventhough no longer than a week ago our Govnt speach was completely different as to how to address this problematic case. God knows what happened in between, maybe an arm twisting by the Germans who want to crack our famous bank secret protection...
Today am glad that finally UN woke up and reminded everyone that the rule of law can't simply be forgotten!

This pretty much guarantees Kosovo Province will remain a glorified colony indefinitely. I doubt those states that recognized Pristina's unilateral declaration of complete and utter dependence on the West will withdraw such recognition, but it places further egg on the faces of those who thought they could just run ramrod over international law. Now maybe the UN could actually grow a pair and implement a policy of delegitimizing the EU's colonial mission.

This is great news. But what really surprised me is the very low number of Albanian comments on this article and their quiet and almost humble responses. So I guess it must be a pretty severe blow to them and they are trying hard to get their act together (I am sure they will be back). Unknown Comic, there is no delay. Gjipela, this is democracy and international law. Smile, it is up to Mr. Ban Kim Moon and the UNSC (and you know how has the upper hand there). The EU has been put into its place again and this public humiliation was what the doctor ordered for some of its arrogant unelected technocrats. At least it has been proven that Serbia's claims on this matter were not some kind of imagination blah blah. There is still a long way to go, but every small battle won counts as well.
